Custom Enclosure Design License Agreement
By checking the box below and submitting payment through AC Sounds, you (“Customer”) acknowledge that you have read, understood, and agreed to the following terms and conditions in full. This Agreement constitutes a legally binding contract between the Customer and AC Sounds (“Company”).
1. Grant of Limited License
Upon receipt of payment, the Company grants the Customer a limited, non-transferable, non-exclusive license to use the purchased custom enclosure design and digital blueprint solely for the Customer’s personal use.
The Customer understands and agrees that the purchase of a design does not constitute a transfer of ownership, copyright, intellectual property rights, or exclusive rights to the design itself.
2. Ownership of Design
All enclosure designs, renderings, schematics, layouts, measurements, digital files, concepts, and related materials created by the Company shall remain the sole and exclusive property of AC Sounds at all times.
The Customer is purchasing access to and use of the digital blueprint only, and not ownership of the intellectual property associated with the design.
3. Personal Use Restriction
The purchased design is licensed strictly for personal use only.
The Customer may not:
Resell the design;
Redistribute the design;
Share the files publicly or privately for commercial purposes;
Manufacture or reproduce the design for resale;
Claim ownership of the design;
Use the design in connection with any competing business or commercial production without prior written consent from the Company.
Any unauthorized reproduction, resale, distribution, or commercial use of the design constitutes a violation of this Agreement and may result in legal action.
4. Non-Refundable Fees
All payments and design fees submitted to the Company are final and non-refundable under any circumstances, including after design work has begun, files have been delivered, or the Customer decides not to use the design.
By submitting payment, the Customer expressly acknowledges and agrees to this non-refundable policy.
5. Company Rights and Future Resale
The Customer understands and agrees that the Company retains full ownership rights to all designs created.
The Company reserves the right, at its sole discretion, to reuse, modify, display, publish, advertise, reproduce, or resell the design in the future, including listing the design for resale on the Company website or related platforms.
The Customer acknowledges that the design may later appear on the Company website, social media, promotional materials, or marketplace listings.
6. Acceptance of Agreement
By checking the acceptance box and completing payment, the Customer electronically agrees to be legally bound by the terms of this Agreement to the fullest extent permitted by law.
The Customer further acknowledges that electronic acceptance and digital acknowledgment shall have the same legal force and effect as a handwritten signature.
